Bad News for California Urologist

Last year, 2013, was an unlucky year for a Salinas, California urologist who was sued twice for medical malpractice. The last time by a patient who claims he had to undergo five unsuccessful lithotripsies for kidney stones between September 2008 and March 2012 that were supposedly driven by the urologist’s greed and profit.

In early December of 2013, a medical malpractice suit was filed saying the repeated procedures were ineffective yet continually administered, causing bodily harm to the patient. The continually repeated lithotripsies caused altered anatomy, weakened kidney function, extreme pain and emotional distress.

Lithotripsy is the surgical procedure to diminish kidney stones. Ultrasound shock waves are used to medically fragment stones in the body.  Once fragmented into gravel, or smaller stones, it will pass through the kidneys and out of the body.

ESWL or extracorporeal shock wave lithotripsy is the most common type. It is a pain-free procedure and typically takes an hour to perform. The patient is usually administered general anesthesia. Often a tube is placed into the kidney to aid in the urine drainage and passing of the kidney stone gravel.

In June of 2012 another case was filed against the same doctor for the same reason. This patient underwent six unsuccessful lithotripsies. The medical malpractice lawsuit contends fraud, battery, and breach of contract, breach of fiduciary duty, infliction of emotional distress, medical negligence, and violations of state and federal business codes. 

The Medical Board of California has publically reprimanded this same urologist on two separate occasions in 2008 and 2012. Once for altering a patient’s records and failing to warn the patient of the side effects of Lupron and once for signing off on a CT scan that showed that he had left a wire in a patient’s bladder.

These types of things can and do happen. No one likes to think that there are such careless and selfish medical professionals in this country but it happens every day. So many times; money, greed and ego get in the way of the oaths they take to serve and care for their patients.
